Governor Jenniffer González signed House Bill 247 into law, amending Law 129-2020, known as the Puerto Rico Condominium Law, to strengthen transparency and protect buyers of properties under the horizontal property regime.
The new Law No. 13-2026, authored by Representative José J. Pérez, establishes the obligation to notify and provide a copy of the condominium bylaws to real estate agents or brokers responsible for selling a unit, as well as to potential buyers who request it. This delivery must be made within a period of no more than five (5) business days, upon verification of the commission or legitimate interest.
According to the Statement of Purpose, the measure seeks to ensure that buyers have sufficient information to make informed decisions, recognizing that the condominium bylaws are the document containing the administrative rules that govern coexistence, the use of units, and common areas.
The law also clearly states that there is no obligation to provide the bylaws to third parties without a legitimate interest in a specific transaction. Furthermore, it establishes identification requirements for those requesting the document, including license number (in the case of brokers), photo identification, and contact information.
In the absence of a managing agent, the responsibility for delivering the bylaws will fall to the President or, failing that, the Secretary of the Board of Directors. Likewise, real estate agents or brokers must be duly authorized in accordance with Law 10-1994, which regulates the profession in Puerto Rico.
This amendment represents an important step toward greater transparency in the real estate market and strengthens consumer protection when acquiring property in a condominium.
